Top cop charged with sexually abusing female officers

A senior police officer has been charged with using his position to sexually abuse a fellow cop.

Samir Yunis was arraigned before chief magistrate Wendy Micheni and he denied one count of abuse of his position.

It is alleged that on June 15, 2019, at Dandora Police Station being the OCS at the station, he took advantage of his position of authority and had sexual intercourse with JM within the police station.

The court had earlier dismissed an application by his defence team which was seeking to defer the plea taking because they had filed a case at the High court seeking to defer the plea.

Yunis who is now the base commander at Ruiru is alleged to have sexually molested several female police officers when he was OCS in different police stations.

According to the Internal Affairs Unit, they have been investigating the conduct of Yunis when he served at Dandora, Kamkunji, Mombasa Central and Pangani police stations after several complaints by female officers.

The said female officers allegedly wrote several complaints to Inspector General and Ipoa claiming that Yunis was using his position to force them into having sex with him.

Those who declined were being harassed and transferred unprocedural.

The women complained that he used his connection to engineer disciplinary actions and make life unbearable for them.

Former Inspector General Hillary Mutyambai directed Internal Affairs Unit to investigate the matter.

IAU says that during investigations, a female officer narrated how he ambushed and sexually assaulted her but despite filing complaints nothing happened.

IAU was able to pin him on one of the cases of a police officer who complained that he raped her within the report office at night.

After completing investigations, IAU forwarded the file to IG and he directed the file to be taken to ODPP for review.

Upon perusal of the file, the DPP said he was convinced that there was enough evidence to sustain charges of abuse of position of authority contrary to section 24(2)(a) of the Sexual Offences Act, 2006 against Yunis.

Section 24(2)(a) states that any person who is a law enforcement officer takes advantage of his or her position and has sexual intercourse or comm it’s any other sexual offence under this Act within the limits of the station to which he or she is appointed.

If convicted, the accused is liable to imprisonment for a term of not less than ten years in jail.

Micheni released him on Sh500,000 bond and one surety or an alternative cash bail of Sh 200,000 and one surety.

The case will be mentioned on December 20.
