Why Solicitor General Kennedy Ogeto is on his way out

The Public Service Commission has invited applications from persons seeking to fill the position of the country's Solicitor General.

The post is currently held by renowned lawyer Kennedy Ogeto.

He was appointed to the position by President Uhuru Kenyatta in March 2018 for a period of five years.

Ogeto assumed the post from Njee Muturi who was then moved to the post of State House Deputy Chief of Staff in changes.

The law provides that the solicitor general serves for a period of five years with the window for renewal for another term.

Ogeto's term is thus set to end in March 2023.

The Solicitor General is the accounting officer at the State Law Office and Department of Justice – currently headed by Attorney General Justin Muturi.

 

Those seeking to fill the post, according to an advertisement by PSC, have until November 14 to submit their applications to the PSC Secretary.

“All applications should reach the commission on or before November 14, 2022 (latest 5 pm),” the notice by PSC chairman Anthony Muchiri reads in part.

Among the requirements is that the applicant is a citizen of Kenya, holds a law degree from a recognized university. 

One must also be an advocate of the High Court of Kenya or holds qualifications from a common law jurisdiction.

At least 10 years of experience is required of the applicant, whom the PSC adds, should be of high moral character, integrity, and impartiality.

Key competencies include management capacity, resource management and supervisory skills.

The applicants must also meet the requirements of Chapter Six of the Constitution on Leadership and Integrity.

“The Solicitor General will serve on a contract of five years. The salary and other benefits attached to the position will be determined by the Salaries and Remuneration Commission,” the notice reads.

PSC is expected to shortlist and interview applicants and make recommendations of suitable persons to President William Ruto for the appointment.

The President would then send the name of the successful applicant to the National Assembly for vetting and approval.

The nominee is thereafter sworn in by taking a pledge on general leadership and integrity and another on accountability if approved by the House.

The Office of the Attorney General Act provides that the Solicitor General shall assist the Attorney General in the performance of the AG’s duties.

“The Solicitor General shall carry out any function, discharge any duty, and exercise any powers as may be directed by the Attorney General,” the law says.
