Mwaure opposes Raila's petition to overturn Ruto's win

The Agano party leader wants to be enjoined in the case as an interested party

Agano Party presidential candidate David Mwaure is seeking to be admitted into the Presidential Petition at the Supreme Court.

Mwaure wants to be enjoined as an interested party to testify against the petition filed by Azimio presidential candidate Raila Odinga.

Raila's petition is among eight others filed at the Apex court to overturn President-elect William Ruto’s August 9 victory.

Mwaure had conceded defeat before the presidential election results were declared and supported Ruto.

In an affidavit submitted at the Apex court, Mwaure has trashed claims by the four dissenting IEBC commissioners that they were excluded during the tallying and verification.

The four commissioners, Juliana Cherera, Francis Wanderi, Irene Masit and Justus Nyangaya have alleged in their parallel affidavits that IEBC chairman Wafula Chebukati ran a one-man show at the commission.

But Mwaure says while at the National Tallying centre, he and his agents noticed that all the commissioners took part in the verification of forms 34As.

“Upon receipt of the original 34A counter-check whether the same were in tandem with form 34A already sent electronically and upon verifying, they would then publicly declare the results,” Mwaure said.

He said those present at the Bomas of Kenya including local and International observers, agreed that the final tallying and verification process was being conducted transparently.

“It is upon realising that Agano party had genuinely lost the election and that the Kenya Kwanza had genuinely won the presidential election that Agano party publicly conceded,” he said.

Mwaure also wants the Supreme Court to dismiss Raila's petition saying it is full of allegations which do not warrant a repeat of the presidential polls.

“That even if there are certain minor arithmetic errors (which are not admitted), it is appropriate to appreciate the fact that the conduct of an election is a very rigorous and highly involving process,” he said.

“In a manner of speaking, in particular, the IEBC officials and for that matter, several agents did not sleep from the night of August 8 to 15 until when the election results were declared.” 

Mwaure said under such tough conditions, any human being is bound to make a mistake or two.

“I state that of small mistakes let not the will of the people be upset by this honourable court,” he said.

Eight petitions have been filed at the Supreme Court with the seven-judge- bench set to hear and determine the case by September 5.
