A Kenyan has moved to court seeking to block Kirinyaga senator-elect James Murango from assuming office on grounds that he has violated Chapter Six of the Constitution.

Antony Murimi says that the senator-elect on a UDA ticket has a pending forgery case at the Mombasa Law court and is therefore not fit for office.

It is alleged that Murango was charged for allegedly forging of Sh8.8 million Kenya Ports Authority tender which Murimi argues violates the laws of integrity

“Pending inter-parties hearing, the court be pleased to issue an interim mandatory injunction suspending gazettement of the senator-elect by the IEBC,” reads court papers.

According to court papers, as a director of ports and harbours support services, he allegedly obtained money from the KPA to supply Grove crane spare parts.

Murimu further claims that the senator-elect was also accused of two counts of forgery, two counts of uttering a fake document and two counts of procurement fraud

It is his argument that Justice Mumbi Ngugi made a determination that all leaders who hold constitutional office and have been charged with corruption should step aside.

“The petition discloses overwhelming grounds for disqualifying the Kirinyanga Senator-elect from assuming office on grounds of failure to satisfy moral and ethical requirements prescribed by the constitution of Kenya, the public office Ethics Act Cap 183,” he argues.
