Two rights groups have filed a case in court seeking to stop IEBC chairman Wafula Chebukati from announcing results of the presidential election before forms 34A and 34B are made available through the public portal.
Kenya Human Rights Commission and Inuka Kenya ni Sisi said the only way to secure the vote is by making the forms available for public scrutiny.
The activists are seeking the implementation of a Court of Appeal decision between the polls agency and Maina Kiai by ensuring that the final results tallied at the constituency level are available to the public, media and other stakeholders.
The purpose is to ensure there is verification to minimise the possibility of interference.
This, they said, will create transparency and reduce the chances of interference by 'rogue' employees of the electoral agency.
"It is necessary for the will of the people to be secured by ensuring that the results from the constituency tallying centres will be uploaded and made available for download to ensure that stakeholders can tally and confirm the veracity of the results," the activists said.
Those sued in the case are the IEBC and Chebukati.
The commission said it has the resources and capacity to ensure that forms 34A and 34B are available to the public and are received from the different constituency returning officers.
