EACC recovers Sh51m house in Mombasa through ADR

Defendants will surrender to EACC the original title within ten days for cancellation of the defendants interest.

The Ethics and Anti-Corruption Commission has recovered a Sh51 million government house in Mombasa which it says had been grabbed by private agencies.

The commission said on Tuesday the defendants agreed to surrender the title to the three bed-roomed house and a servant quarter through alternative dispute resolution.

"By consent adopted by Mombasa Environment and Land Court, defendants will surrender to EACC the original title within ten days for cancellation of the defendants' interest and rectification of the entries in favor of KCAA, the original owner of the grabbed property," EACC said.

The commission said by adopting the consent between EACC and the Defendants, the Environment and land Court sitting in Mombasa issued a permanent injunction restraining the defendants jointly and severally from leasing, transferring, charging, taking possession and dealing with the property in any manner.

The commission embraced the Alternative Disputes Resolution (ADR) mechanisms in 2019 in an effort to solve civil cases faster.

The ADR has since increased the success rate in asset recoveries, the biggest milestone being the recovery of 11 properties belonging to Bomet and Nakuru counties worth Sh780 million in March 2019.

They comprise two blocks of land belonging to Nakuru Municipality estimated at Sh116.2 million, 27 public officers’ residences and two parcels of land reserved for a survey camp for the Department of Survey in Nakuru.

Others are two blocks of land valued at Sh4.2 million reserved for the construction of a stadium in Sotik township in Bometand Sh150 million Postal Corporation land which was disrupted during an irregular alienation process in Nakuru town along Kenyatta Avenue.
