I can't tell if Embu brothers jumped from van or not, says witness

Crime scene investigator tells court he went to the scene at 3 am to take pictures

A witness in the Kianjakoma murder trial where six officers are charged with killing two brothers says he was informed that the victims jumped from a police car.

In the case police officers Benson Mputhia, Consolata Kariuki, Nicholas Cheruyoit, Martin Wanyama, Lilian Chemuna and James Mwaniki are charged with the murder of brothers Benson and Emmanuel Ndwiga.

Embu crime scene investigator Henry Kiboma told court on Monday, that he was called on the morning of August 2 by his boss and told to go and take photos at a scene.

The brothers were arrested on August 1 by police for allegedly flouting curfew but were later found dead.

Kiboma claimed he received a phone called from the subcounty Criminal Investigating Officer to go to a scene where it had been reported two suspects who had been arrested jumped from a police car

Kiboma told justice Daniel Ogembo that he went to the scene at 3am to take pictures.

When he got to the scene, Kiboma said he saw the first brother lying on the left side of the road while part of his legs were on the tarmac.

“Photos marked 1, 2 and 3 shows a close-up view of the body of the first deceased suspect lying on left side of the road,” he said.

According to his testimony, the deceased had blood stains on his clothes and there was blood on the ground.

A few metres from there, Kiboma said he saw the other brother also lying on the road in the same state.

He took photographs as he usually does in each crime scene and went back to his duties.

Four days later on August 6, Ipoa officers went to Embu and Kiboma said he accompanied them to the scene where he took other pictures at the scene of crime.

He said he took the Ipoa officers to the alleged crime scene, saying even though the bodies were not there, blood was still visible.

He produced in court pictures that he took on August 2 and 6.

The judge was shown separate photographs of both brothers lying dead on the ground that night.

In cross-examination Kiboma said he only went to the scene to take pictures but he cannot ascertain if the brothers jumped from the Land Cruiser.

When asked by lawyer Danstan Omari for the first accused if it possible that the victims jumped, he said it’s possible but he is not sure.

Omari also took him to task to explain why he went to the crime scene four days later with Ipoa and asked if it was normal practice.

Kiboma told the court he accompanied Ipoa officers to show them the crime scene.
