Police probe missing nude photos videos in Linturi case

The nude video and photos were to be used as evidence.

The lead investigator in Meru Senator Muthika Linturi's attempted rape case has testified police are investigating claims that nude photos and videos were destroyed.

Linturi has been charged with attempted rape. It is alleged he entered  the victim’s hotel room and attempted to rape her while her husband was gone.

In a new affidavit filed in court, police officer Keith Roberts says they believethe legislator played a key role in deleting the nude photos.

Roberts has told the court that forensic analysis and reconstruction on  mobile phones is ongoing to retrieve the lost data.

However, he has attached two videos  taken at the scene of the crime.

He further said the investigations into the compliant made by the victim were conducted objectively, conclusively and in the best interests of justice.

He has asked court to dismiss the application by Linturi seeking to terminate the attempted rape charge because the police failed to provide documents in their possession.

He says terminating the case will not give the victim the justice she deserves.

Linturi also wanted the state to produce an abstract from the Nanyuki police station, nude photographs and videos that the victim and her husband took of him at Maiyan Villas on that day.

The charge sheet says that on January 30, 2021, at around 3am at Maiyan Villas hotel in Nanyuki, Linturi  intentionally and unlawfully attempted to rape the 36-year-old woman.

He faces another count of indecently touching the woman without her consent.

Last week, an activist asked the court to moved to compel DCI to investigate Linturi for several offences, including forgery, and his role in the death of his housegirl and business associate.

Through lawyer Danstan Omari, Michael Makarena said the senator is not a graduate as he says and his degree from India is fake.
