Edward Ndichu failed to take plea for a third time after saying he has tested positive for Covid-19, a Kibera court was told.

This comes after he failed to take a plea on the ground that his employer refused to give him time off to attend the court.

His brother Paul Ndichu has already been charged but Edward has skipped the charges yet again.

Their lawyer said the accused person contracted the virus on March 12. 

“One of the accused persons is in quarantine isolating himself after showing some symptoms related to Covid-19, while Edward contracted the virus on March 12. We expect them out on March 26,” the lawyer told Kibera chief magistrate Ann Mwangi.

The lawyer gave the court Edward's Covid-19 certificate as proof.

Edward alongside his brother skipped the first court session and the court was informed that they were in the UK.

In response, the victim’s lawyer Phillip Murgor told the court that the accused persons were politically and financially connected and were taking the court for granted.

In the previous court session, one of the Ndichu brothers was charged with assault and malicious damage.

Paul was charged but denied the charges and was released on Sh100, 000 bond with cash bail of the same amount.

The charge sheet that was read in court said that Paul and Edward destroyed the motor vehicle side mirrors valued at Sh87,000, property belonging to Samuel Dennis Ramdas.

Paul, the court heard on Wednesday, assaulted Cheryl Murgor, causing her bodily harm at the Emara Ole Sereni Hotel in Nairobi. 

He is also alleged to have assaulted Patrick Koech on the same date, time, and place.

The charge sheet further said he assaulted Stephanie Murgor and Chelimo Murgor.

Edward is said to have assaulted Samuel Ramdas at the same hotel.

Yesterday, the magistrate  differed the plea and directed that the matter be mentioned on March 30.
