Two people arraigned over Sh15m mining fraud released on bail

Two businessmen were on Monday charged with obtaining over Sh15 million from another trader pretending that they would partner with him in a business dealing in old colonial antiques.

Jackson Ndungu Chuthi and Peter Karimi Miano and  Jaccrep Antiques and Mining company appeared before Milimani chief magistrate Wendy Micheni Wendy and denied two counts of fraud charges levelled against them by the State.

In the first count, all the accused persons are charged that on  June 29, 2020, at an unknown place within the country, jointly with others not before the court with intent to defraud,  conspired together to make a document namely a certificate of competency serial number 2915/20 purporting it to be a genuine certificate of competency made and signed by CS  Ministry of Petroleum and Mining John Munyes.

Chuthi and Miano are separately charged that on diverse dates between September 7, 2019, and January 15, 2021, in Nairobi jointly with others not before the court, with intent to defraud, obtained a total amount of Sh15 million from Eng. James Ndoria Mwitari while falsely pretending that they would partner with him in a business dealing in old colonial antiques.

The magistrate ordered each of them to be released on a cash bail of Sh500,000 after lawyer Lewis Kanyoko successfully applied for a review of their earlier cash bail of Sh 1 million.
