Four cops, businessman arrested over murder in Kakamega

Four police officers and a bar owner have been arrested in connection with the death of a man arrested in Kakamega town in December 2019.

Senior Sergeant Michael Cherugut, police constables Duncan Wafula, Francis Kayemit and Juma Musa and a businessman Denis Rosana were arrested on Friday afternoon after a Kakamega court Inquest recommended they be charged with murder of 40-year-old Raymond Mulanda.

The four officers are bases at the Kakamega Central Police station where they are currently locked up pending arraignment in court.

Rosana is the owner of the bar Balozi bar in Kakamega town from where the deceased was arrested by the police before his body was discovered at the Kakamega general hospital mortuary the following day.

Kakamega Principal Magistrate Malesi found the five culpable of murder and committed them to the Kakamega police station pending their plea taking.

A police officer Patrick Ogolla who investigates the incident was arrested in December by the Ethics and Anti Corruption Commission for receiving a Sh40, 000 bribe to influence the outcome of the inquiry into the death of Mulanda.

Mulanda was reported to have been arrested from a bar by the four officers after the owner called them in that the deceased was causing disturbance.

The officers said that he overpowered them and jumped from a moving vehicle, sustaining serious head injuries. They booked him at the Kakamega general hospital as an identified person.

His relatives queries the cause of his death and police opened an inquiry file, which the Office of the Director of Public Prosecution (ODPP) placed before court for a public Inquest. Magistrate Malesi on Thursday rules that the five were culpable for murder.

An autopsy by Kakamega general hospital pathologist Dr Dickson Mchana revealed that the head injuries were secondary to blunt force trauma following a fall from height.

In his opinion, the injuries were not consistent with the motion.Mulanda is said to have had gone to a local club to collect a mobile phone he had left there charging.

Police officers at the club allegedly ordered him out, accusing him of being drunk and causing a disturbance.

A confrontation ensued and an officer called for reinforcement. The deceased was taken away in a police vehicle.

The officers are said to have dropped the deceased from the vehicle but passers-by raised the alarm, forcing the officers to pick the unconscious man and drive off.
