DJ Evolve withdraws attempted murder case against MP Babu Owino

He will however be prosecuted in the second count of behaving in a disorderly manner while carrying a firearm.

Felix Orinda, popularly known as DJ Evolve, has withdrawn the case against Embakasi East MP Babu Owino in which the legislator was accused of attempted murder.

Babu will however be prosecuted for a second count of behaving in a disorderly manner while carrying a firearm.

Babu had attempted to settle his case with DJ Evolve out of court.

The MP was charged with attempting to kill Evolve whom he shot at a club in Kilimani, Nairobi, in 2018.

DJ Evolve made an application seeking to withdraw the matter, saying he had reconciled and wants to focus on his recovery.

Senior principal magistrate Benard Ochoi said Owino and Evolve were friends before the incident and have maintained that friendship even after the shooting.

“The accused is currently undertaking certain obligations and still undertaking in relation to the welfare of the complainant,” Ochoi said.

He further ruled that due to the said facts, the court should encourage reconciliation.

"Taking all the above into account, I have come to the conclusion that this is a matter where the court should encourage reconciliation as envisaged in the Constitution and therefore I will allow the withdrawal against the accused in count one; the accused is acquitted," Ochoi ruled.

Ochoi had initially declined to withdraw the matter, saying the details of the reconciliation were not disclosed to court.
