A member of the Orange party has moved to the Political Parties Tribunal challenging businessman Jimmy Wanjigi’s presidential candidature.

Complainant Catherine Wanjiku Irungu has accused the party of failing to conduct an objective ethics and integrity test on Wanjigi.

The petitioner said that the move has allowed Wanjigi to act with impunity including slandering the party leader and causing confusion by laying out rebellious parallel party structures like offices.

Irungu added that Wanjigi is yet to be a proper member of ODM.

Through advocate Edwin Saluny of Saluny Advocates, the petitioner argues that Jimmy should be stopped from further causing confusion to the party and its members.

“That it is also imperative that the respondent be stopped from further plunging the membership into confusion by misapplying the Constitution thereof, and permitting strangers to abuse the structures of the party and especially the sacrosanct pillar of ethics and integrity,” Saluny said.

He added that Wanjigi has demonstrated the ability, predisposition, and inclination to frustrate the Constitution of the party.

“Unless this application is heard and determined urgently, the entire party stands to lose its reputation and standing in the political spheres, which cannot be remedied by way of damages.”

The tribunal certified the matter as urgent, adding that a mandatory injunction is issued to Wanjigi to table the minutes before the tribunal indicating how the ODM NEC awarded him the party membership.

It has also issued a prohibitory injunction restraining Wanjigi, his servants, agents, or employees from permitting the interested party to contests in the party’s electoral processes.
