Blow for Havi as court halts meeting to replace CEO

Embattled LSK chief excutive Mercy Wambua has sued to stop the society’s president Nelson Havi from holding a special AGM to eject her from office.

A Nairobi court on Tuesday ordered Havi not hold a special AGM.

The Employment and Labor Relations court on Tuesday issued conservatory orders restraining Havi and his agents from convening the meeting which had been slated for Saturday, saying the move would violate Wambua’s rights.

Havi had written to Wambua's deputy to organise the meeting and among the agenda to be discussed was commencing recruitment for Wambua’s replacement.

The struggle for control of the society started in September when LSK’s council suspended Wambua on claims of gross misconduct and abuse of office. The council, however, decided in a 9-3 vote 30 days later to reinstate her.

Havi, however, has insisted, alongside two other council members that Wambua is no longer the society’s CEO, often referring to her as “the former secretary.”

But in the case certified urgent by judge Nzioka Wa Makau, Wambua complains that Havi and his agents have been harassing her through a litany of letters, social media posts and media interviews in a campaign to malign her with falsehoods and breach her rights.

An interparties hearing for the case is slated for December 4.
