A man who sought the removal of four Supreme Court judges over alleged gross misconduct has withdrawn his complaint.

Mohammed Sheikh in his withdrawal notice on Monday indicated that he does not want to pursue any complaint against justices Jacktone Ojwang’, Mohammed Ibrahim, Smokin Wanjala and Njoki Ndung’u.

Sheikh filed the petition on March 13. 

He asked the Judicial Service Commission to disregard his allegations against the four judges.

“Take notice that the petitioner herein Mohammed Sheikh ....wishes to wholly, voluntarily and without condition withdraw the petition for all purposes,” read the notice.

He did not give a detailed reason for his change of heart. However other petitioners who filed a similar complaint against the four judges are yet to withdraw.

Sheikh's decision to withdraw the complaint comes even as the JSC last week recommended to President Uhuru Kenyatta to appoint a tribunal to probe judge Ojwang’.

The JSC had received a complaint against the four last week accusing them of violating the Constitution when issuing a verdict on the Wajir gubernatorial election petition.
