Karua on spot after records show her election agents weren't barred

IEBC's lawyer put politician Martha Karua to task on Monday after records showed her agents were inside polling stations, contrary to her claims.

The Narc Kenya leader claimed they were barred during the vote on August 8, 2017 but the commission's records showed they signed documents at the closure of the centres.

They also showed that at the polling stations in question, Karua had more votes than her key rival Anne Waiguru who became Kirinyaga Governor.

This cast more doubt on whether her agents were absent.

The Narc Kenya chief had also complained that some agents went to the station earlier than expected. It emerged yesterday that some of hers reported as early as 4am and others after the required time, as was the case with other parties.

"My client has no case to answer and Karua's testimony amounts to abuse of the court process," IEBC lawyer John Kathungu argued.

Keruguya court officer Jackson Kibiru denied receiving a flash disk with evidence from the petitioner.

Karua insists he did but the officer said it was not in the list of items he received.

Waiguru's lawyer Paul Nyamondi said he could not on evidence in a video he had not seen.

When she filed the petition in September last year, Karua claimed there was evidence of massive voter bribery at polling stations and that her agents were barred from the locations.

She said evidence in her possession showed a count of 58,000 votes was illegally entered into IEBC's KIEMS to aid Waiguru's win.

The politician further alleged the forgery of the form 37A used to transmit results from polling centers to the county tallying centre.

Waiguru was declared winner after garnering 159,606 votes against Karua's 120,341.

The hearing continues on Tuesday.
