Win for Jubilee as court upholds Rachel Nyamai's election

A High Court has upheld the election of Kitui South MP Rachel Nyamai and dismissed her rival's petition.

Justice Lillian Mutende

dismissed with costs, the suit filed by Nyamai's opponent Kennedy Moki of Wiper Party.

Moki had claimed his rival was fraudulently nominated by Jubilee Party for the vote that took place on August 8, 2017.

In a judgement that lasted about 30 minutes on Wednesday, Mutende noted there was no evidence of malpractices such as bribery as the petitioner claimed.

Moki also alleged that Nyamai

intimidated his voters and agents.

The judge awarded Nyamai and the IEBC Sh1 million each.

Lawyers Nyamu Mati for

Nyamai and Kenneth Mumbo for the petitioner were present during the delivery of the judgement.
