Petitions against two Kilifi MPs struck off

Two MPs from Kilifi County were on Tuesday cleared by the high court after petitions against their August win were struck out.

High Court Judge Justice Dorah Chepkwony sitting in Malindi dismissed separately petitions against Kaloleni MP Paul Katana and Ken Chonga of Kilifi South.

Justice Chepkwony ordered the petitioners Samuel Mulwa and Suleiman Kaingu who are voters pay the cost of Sh1 million each.

She said the two petitions were defective.

Justice Chepkwony said in the first case against Katana, two petitions bearing the same date had been attached to it.

She said there was evidence that the petitioner swapped the second petition with the first petition.

"The petitioner could only amend the petition with the leave of the court as required by law which was never sought,' she said.

In the second one, Justice Chepkwony said the petition was incompetent and had anomalies that are deeply-rooted.

Kaingu a resident of Kilifi South and a supporter of former MP Mustafa Idd of Jubilee Party had accused the IEBC and Returning Officer Neema Karisa of presiding illegalities.

These are not the only petitions which have been struck off by the Malindi high court.

Other petitions that were struck off for being defective include those against; Kilifi Woman representative

Gertrude Mwanyanje, Senator Stewart Madzayo and Ganze MP Teddy Mwambire.

Katana and Chonga of ODM party emerged victorious after beating former MP Gunga Mwinga of Devolution Party of Kenya and former MP Mustaafa Idd of JP Party in Kaloleni and Kilifi South respectively.
