AN assault case against human rights activist Al Amin Kimathi was withdrawn yesterday after his wife and a school head said they had forgiven him.

His wife Farida Saad and school principal Fatuma Ali told the court the case was a family matter and would be solved out of court.

Chief magistrate Heston Nyaga said he had no objection.

However, the court maintained the second count of malicious damage, pending proof of payment.

Kimathi was accused of beating up Saad and injuring her on September 9 last year.

He was also charged with assaulting Ali, who intervened in the dispute.

Kimathi is also accused of damaging Sh17,500 school property.

The case will be mentioned on Thursday, when the second count will be withdrawn.
