Businessman Rai to pay Butali Sugar Sh508m in damages

Businessman Jaswant Rai will now pay Butali Sugar Limited Sh508 million for damages, Judge Alfred Mabeya has ruled.

The suit was instituted on March 30, 2007, by Butali Sugar Mills Limited against West Kenya Sugar and Kenya Sugar Board.

It sought Sh590 million being losses incurred as a consequence of the unlawful interference with its business.

"On the totality of the evidence on record, Butali has proved its case on a balance of probability," Justice Alfred Mabeya said on Friday.

"The sum of Sh508 million shall attract interest at the rate of 12 per cent per annum from the date of the suit until payment in full."

On August 31, Rai filed a notice to withdraw all applications he had filed before the Court of Appeal and the High Court.

Three notices were filed at the court of appeal by West Sugar which is owned by Rai and one at the Milimani Commercial Courts by Rai and his firm.
