NLC to hive off Nairobi National Park's 100 acres for SGR

At least 100 acres of the Nairobi National Park and 40 acres of Oloolua forest will be hived off for construction of Phase 2A of the Standard Gauge Railway.

The National Land Commission notified the public on its intention to acquire land on behalf of Kenya Railways.

This is with a view to unlocking the construction that has stalled for months in the face of court injunctions by environment activists and disputes with landowners.

Apart from the park and the forest land that is yet to be de-gazetted, NLC wants to acquire over 1,000 parcels of private land from the Nairobi National Park to Suswa.

NLC chair Muhammad Swazuri said in a December 22 Kenya Gazette notice that the acquisition is in accordance with Sections 112 and 162 (2) of the Land Act, 2012.

"The NLC gives notice that the government intends to acquire the parcels of land in Kiambu, Kajiado, Nakuru and Narok counties for the public's purpose," the notice reads in part.

"Plans of the affected land may be inspected during office hours at the office of the National Land Commission, Ardhi House, 3rd Floor Room No. 305."

He said those wishing to find out more about the planned acquisition can visit the county coordinators offices in Kiambu, Kajiado, Nakuru, and Narok.

The commission said owners of the affected parcels of land have fifteen days to inspect and put in their claims for compensation.

As per last year's amended land laws, failure to lay claim means the government can take over the ownership of those pieces of land in public interest even without compensation.

The Act allows the commission to take possession of uncultivated or pasture or arable land upon expiry of the fifteen days from the date of publication of the notice of intention to acquire.

"On the expiry of that time, the Commission shall, notwithstanding that no award has been made, take possession of that land," Article 82 of the Land Law Amendment Act 2016, reads in part.
