Petitioner challenges appointment of Adan Mohamed as KRA Commissioner General

Petitioner is seeking conservatory orders to halt assumption of office pending determination of the case

The High Court has scheduled May 27 for the hearing of an application seeking to suspend the appointment of Adan Mohamed as Commissioner General of the Kenya Revenue Authority (KRA), following a petition challenging the process leading to his appointment.

‎In directions issued by Justice Gregory Mutai, the court ordered that the petition and accompanying application dated May 19, 2026, be served upon all respondents by 5pm on May 20.

‎The respondents, including the Treasury Cabinet Secretary, the Attorney General, KRA, the Public Service Commission, the Chief of Staff and Head of Public Service, and Adan Mohamed himself, were directed to file and serve their responses by May 22.

‎“The Notice of Motion application dated 19th May 2026 shall be heard on the 27th day of May 2026,” Justice Mutai of Milimani High Court directed.

‎The court further allowed both parties to file skeleton submissions, lists and bundles of authorities and case digests before May 26 ahead of the hearing.

According to court documents, the petitioner Benard Opere alleges that the appointment contravenes constitutional and public service regulations relating to the mandatory retirement age for public officers.

Mohamed was appointed through Gazette Notice No. 7393 dated May 18, 2026, by Treasury CS Mbadi, giving him a three-year term at the helm of the tax authority.

Opere is seeking conservatory orders to stop Mohamed from assuming office pending determination of the case.

‎“Unless this Honourable Court urgently intervenes by granting the conservatory orders sought, the 6th Respondent will assume and exercise the powers and functions of Commissioner General of the Kenya Revenue Authority,” the affidavit says.
