
The Kenya Human Rights Commission has urged authorities to suspend mining activities in Ramula, Siaya county following the killing of two individuals who had confronted police officers over alleged forced evictions.
The commission demanded the immediate suspension of the mining activities conducted by Shanta Gold Limited in Ramula and across Nyanza until it fully complies with the law.
In a press statement released on Friday, the commission said the discovery of gold by Shanta Gold Limited in the area caused fear, division and tension, but the company continued its mining process.
"Despite these concerns, the company has continued its activities with state protection, including police sent against unarmed residents seeking accountability," KHRC said.
Given the company's substantial state support, the commission voiced concerns about the identity and interests of its supporters.
The organisation condemned the killing of community members, defending their protests as concerns about land rights, lack of consent and transparency in local mining activities.
"Instead of listening or calming the situation, police responded with violence, even using live ammunition against unarmed people."
The commission further expressed concerns over alleged harassment by DCI officers and the involvement of the Ministry of Interior instead of the Ministry of Mining and Blue Economy.
"Turning this process into a security matter is unlawful and inappropriate," the commission said.
KHRC demanded a swift investigation and the arrest of police officers who discharged live ammunition against peaceful protesters.
"Command responsibility must be enforced without exception," It said.
The commission also called upon the Parliament to summon the State Department for Mining to account for the legal and procedural basis for the issuance of licenses and operations allowed despite legal concerns and procedural irregularities.
The commission further called for accountability from the ODPP over the charges held against the protesters.
"The use of the criminal justice system to intimidate, harass, and silence citizens is an abuse of prosecutorial power and must cease immediately."
