An anti-corruption court is today set to resume with the defence hearing in a revived Sh60 million alleged graft case involving former Lands Minister Amos Kimunya.

Kimunya, together with three others, is facing allegations of unlawfully allocating a 25-acre public parcel of land to Midlands Limited during his tenure as minister.

According to prosecutors, the allocation, valued at about Sh60 million, was irregular and contravened procurement laws.

The former minister has consistently denied any wrongdoing, maintaining that the process followed all legal requirements and that he had no influence over the allocation.

The case, which had earlier ended in his acquittal, was reopened after the Court of Appeal overturned the decision and ordered a fresh trial, now at the defence stage.

During a past court session on July 14, Kimunya told the court that the prosecution had failed to establish any element of fraud against him.

He explained that his role as Lands Minister was strictly guided by law, adding that the trustee position at the centre of the case was under the jurisdiction of the Finance and Agriculture ministers.

Kimunya further argued that Midlands Limited, the company at the centre of the dispute, was a public entity owned by farmers in Nyandarua to add value to their produce.

The contested land formed part of a 75-acre parcel initially allocated to the Njabini Agricultural Training Centre, a government institution established to support farmer training and agricultural development.

The defence hearing is scheduled to continue today.
