IEBC Commissioner Justus Nyang'aya resigns

He resigned from office hours after Ruto suspended him.

IEBC commissioner Justice Nyang'aya has resigned.

“It is with a heavy heart that I tender my resignation as a commissioner of the IEBC effective today (Friday),” Nyang'aya said in a letter to President William Ruto.

Nyang'aya said he made the decision in the best interests of the country saying it supersedes individual interests.

"I have always endeavoured to act in the best interest of the country, although my actions, taken in a good faith have been misconstrued," he added.

He said in the last few weeks, he had gotten into soul searching and prayers, leading to the decision.

"In the last few weeks, I have had serious soul searching and being a man of faith, prayed fervently so that I may have the wisdom to make a decision that is in the best interest of the country," he said. 

He expressed his gratitude for the opportunity he had been accorded to serve in the position.

Nyanga'aya and three other commissioners are accused of attempting to subvert the will of the people with regard to the August 9 presidential elections

The three others are Vice Chair Juliana Cherera, Commissioners Irene Masit and Francis Wanderi.

The four disowned results were announced by IEBC Chair Wafula Chebukati.

Nyang'aya's resignation comes hours after President  Ruto suspended him and the three other commissioners from office following a recommendation of the Justice and Legal Affairs committee of the National Assembly.

President William Ruto on Friday also formed a five-member committee that will probe the suspended commissioners.

It will be chaired by High Court Judge Aggrey Muchelule, with the lead counsel Peter Munge Murage being a member of the tribunal.

"The mandate of the Tribunal shall be to consider the Petition for the removal of (1) Juliana Whonge Cherera, (2) Francis Mathenge Wanderi, (3) Irene Cherop Masit and (4) Justus Abonyo Nyang’aya from office as members of Independent Electoral and Boundaries Commission (IEBC) and to inquire into the allegations therein," the President said in a gazette notice.
