Miguna refuses to get emergency travel document for Kenya travel

He said the embassy has been ordered to issue a travel document.

Kenyan lawyer Miguna Miguna has changed his mind minutes after welcoming the High Court’s directive that he should collect documents from the Kenyan embassy in Canada within 72 hours to allow him to travel to Kenya.

In a Twitter post that he updated following the ruling that was made by Justice Hedwig Ong'undi on Monday that Foreign Affairs CS Raychelle Omamo must ensure the said order is complied with, Miguna said that he is a Kenyan citizen by birth, and does not need to obtain another document from the embassy in Ottawa or Berlin.

“I'm not visiting the Kenyan Embassy to apply for citizenship which I never lost. The Court has once more affirmed that I am a Kenyan by birth who must enter Kenya as a Kenyan upon presentation of my National ID card,” Miguna said.

"The Embassy has been ordered to issue a travel document.”

The court had said that once in possession of the emergency travel document, Air France should allow Miguna to board an available flight to Kenya with immediate effect.

"Upon landing, he be allowed to use his ID for purposes of identification," said the judge.

APPLY FOR PASSPORT

Once in Kenya, Miguna should immediately apply for a Kenyan passport and the same issued to him within seven days as long as all requirements are complied with.

Miguna was expected to travel back to the country on November 16, but the airlines denied him passage, saying that the government had issued red alerts.

He was informed about the new development at the Berlin Brandenburg Airport in Germany.

The move aroused anger from a section of Kenyans and human rights activists who said that the government should allow him to come back to his country.

Former Chief Justice Willy Mutunga lashed out at the government for blocking the lawyer's entry, again.

Mutunga said the government was acting in total impunity by issuing red alerts to airlines, adding that the same government has repeatedly ignored court orders.

“As United Progressive Front, we shall fight to ensure that all orders that come from the judiciary are respected and enforced,” Mutunga said.
