Kiambu county official jailed over contempt of court

Kimani failed to comply with orders to pay Sh52 million to a city lawyer.

A Milimani law court has jailed Kiambu County Chief Finance Officer William Kimani for six months for disobeying court orders.

Lady Justice Roselyne Aburili handed the sentence after finding the county officer at fault for failing to comply with court orders issued which required him to pay Sh52 million to a city lawyer.

 The court had ordered the officer to pay the money to the lawyer in 2022 for services offered to the county government.

 The court ordered him to appear in court again on March 17 this year over the same matter but he disobeyed the court again.

 After allegedly evading the court for about a year, Kimani finally surrendered on Tuesday when he was handed the sentence without the option of a fine.

 He surrendered on his own after the Judicial Review Division Court in Milimani issued an order directing the Kiambu county police commander to arrest him and present him in court.

 The city lawyer had urged the court to jail Kimani for disobeying court orders repeatedly.

 While reading the ruling, Justice Aburili also ordered the Kiambu county government to settle the Sh52 million owed to the lawyer.

 “There is evidence that indeed the order the respondents are alleged to be in contempt of was extracted, and on its face, there is endorsed a penal notice warning the respondents that disobedience of the order would be in contempt of court and would attract penal consequences,” the ruling read in part.

 Kimani is being held at the Milimani Law Courts holding cells, awaiting transfer to the Industrial Area Remand Prison where he will serve his jail term.

 The law allows him 14 days window within which to file an appeal in the event he is dissatisfied with the decision of the court finding him guilty and sentencing him.
