Director of Public Prosecutions now says it will soon gazette its own charge sheet.

This means that the police will no longer present their own charge sheet.

Speaking during a workshop in Mombasa on Thursday, deputy director Victor Mule said this shall be used under the guidelines on the decision to charge.

The police will only recommend what one should be charged with. The ODPP will however not be tied to the recommendation. 

"We are replacing the charge sheet . Once we get the notes from the police, we type them, sign and present them to court. Police will investigate and hand over everything to us," he said.

"However, the DPP will not be bound with it."

The ODPP said the law is very clear on who should draft a charge sheet. 

"We are not saying the police can’t propose. We will know whether to adopt the charges or propose new ones," he said.

The police have been insisting that they should retain power to draft charge sheet.
