AN officer charged with kidnapping the Embu speaker has accused the Directorate of Criminal Investigations boss of malice.
Nicholas Kangangi says although there is no evidence he kidnapped Kariuki Mate, the DCI had him arrested.
“I write to bring to your attention the abuse of the court process by my seniors, the police and the DPP in their attempts to settle personal differences,” he says in a letter to Chief Justice Willy Mutunga.
Kangangi urged the CJ to recommend Ipoa or the police investigate the circumstances in the case.
He said Ipoa and the police declined to act, claiming the matter is still in court.
Kangangi appealed to Mutunga to review the case file in which he says he was maliciously charged with abducting Mate.
He says his prosecution arises from a family dispute, which started in 2002.
It involved his father Joseph Njagi and his uncles Robert Njagi, Kinegeni Njagi, Clement Kiragu and Salesio Kiragu, over collection of rent from property in Embu town.
Kangangi says after the case was decided in 2009, he was attacked by his uncles and cousin in 2012.
The matter was reported to Manyatta police station and the DPP’s Embu office, which recommended the suspects be charged with malicious damage to property and giving false information. “I had been called by a senior police officer, Mr Lungunza, an assistant commissioner of police. He warned me that DCI boss Ndegwa Muhoro was interested in the case and I should withdraw it or face the music,” Kangangi said.
He also met Kenneth Githinji, a relative who was also a suspect in the malicious damage case.
Kangangi said Githinji threatened “I would get it hot from Muhoro if I proceeded with the case”.
