
Two men will remain in custody after a Nairobi court directed that a pre-bail report be prepared before determining their release terms.
The suspects, Jackson Apollo and Alvin Oduya, were arraigned before Senior Principal Magistrate Carolyne Nyaguthii at the Milimani Law Courts, where they denied charges of obtaining money by false pretences and conspiracy to defraud, contrary to Sections 313 and 317 of the Penal Code.
The two are accused of allegedly defrauding a woman of USD 116,000 (about Sh15.36 million) at Serena Hotel in Nairobi by purporting they could assist her in a business deal.
According to the charge sheet, the alleged offence took place on April 30, 2025, when the two reportedly obtained the money from Grace Tutysime by falsely claiming they could help her in a business transaction.
Through their lawyer, the accused requested that the court grant them lenient bail terms.
“My clients are law-abiding citizens and the sole breadwinners for their families. We urge the court to consider favourable bail terms,” the defence counsel told the court.
The prosecution said it did not oppose the suspects’ release on bail but asked the court to impose reasonable conditions.
“We have no objection to the accused being released on bail, but we urge the court to impose reasonable terms commensurate with the nature of the offence,” the prosecutor stated, noting that the investigating officer also did not object to bail.
In her ruling, Magistrate Nyaguthii directed that a pre-bail report be filed before making a decision.
“I will order that a pre-bail report be prepared before the court gives its ruling on bond,” she said.
The court ordered that the two be remanded at Central Police Station pending the preparation of the report.
The case will be mentioned on October 9, 2025, when the report will be presented, and the court is expected to give its ruling on bail.
