Two police officers, Milton Odhiambo and James Thuo, are awaiting the final verdict in a criminal case in which they were charged over an alleged Sh3.4 million pension fraud.

The two were arraigned in 2020 in connection with allegations that they aided and abetted the fraudulent processing and payment of pension benefits, and that they failed to prevent the offence while performing their duties as claim officers.

At the time of their arraignment, Barasa was serving as the Deputy Officer Commanding Station (OCS) in Narok, while Njuguna was based in Kilifi.

Barasa and Njuguna denied two counts of conspiracy to defraud and neglecting their duties.

The State prosecutor told the court the two allegedly conspired to defraud the police pension department of Sh3,482,451 by preparing and approving a forged claim for one Samuel Kiprotich.

Prosecutors allege that the two officers, acting as claim processing officials, were involved in the irregular facilitation of pension funds, leading to the multi-million-shilling loss.

The defence has maintained that they did not commit any offence, urging the court to acquit them.

They both denied the charges and were each released on Sh500,000 cash bail.

The court is now expected to deliver its final decision in the matter.
