A Milimani court has summoned the investigating officer handling the cybercrime case against social media influencer Francis Gaitho, who is facing charges of publishing false information.

The summons was issued on July 14, 2025, by Chief Magistrate Susan Shitubi during a mention of the case.

The magistrate directed the officer to appear in court, and the case was adjourned to August 12, 2025.

The summons follows a warrant of arrest that had been issued earlier on June 30, 2025, by Senior Principal Magistrate Robinson Ondieki after the prosecution accused Gaitho of repeatedly failing to attend court proceedings.

"The court allows the application. A warrant of arrest is hereby issued," ruled Magistrate Ondieki at the time.

Gaitho, who was first arrested in July 2024 during the Gen Z protests, is accused of posting false information on X (formerly Twitter).

According to the charge sheet, Gaitho claimed that the Directorate of Criminal Investigations (DCI) had arrested the wrong suspect in connection with the Kware murders, where several bodies of women were discovered in Nairobi.

Police had arrested Collins Jumaisi in connection with the killings. Jumaisi allegedly confessed to the crimes but later escaped from Gigiri Police Station and remains at large.

Prosecutors say Gaitho’s July 15, 2024, post was presented as factual and could mislead the public and obstruct justice.

He also faces a second charge of publishing false information that allegedly exposed an innocent person to potential harm.

Gaitho denied the charges and was released on a cash bail of Sh30,000. However, his continued absence in court has now prompted fresh legal steps to compel his attendance.
