

A man who was charged with human trafficking was on Friday released on a bond of Sh100,000 with a surety of a similar amount.
The accused is alleged to have trafficked a Mohamed Ali Noor from Wajir to Nairobi by means of deception for the purpose of labour exploitation.
The state had opposed the release of Adam Ali Mohamed, but Milimani Principal Magistrate Paul Mutai ordered that he be freed after depositing the bond.
The investigating officer submitted that the accused poses a flight risks and through the assistance of accomplices, some of whom are still at large, could escape the jurisdiction of the court.
The officer further argued the cooperation of the accused is essential in apprehending his co-suspects and urged the court to deny him cash bail.
He recommended, in the alternative, a surety bond with at least one contact person.
In response, counsel for the accused argued that there is no information or history on the accused person, suggesting that he is of flight risk.
He stated that Mohamed had been in custody for 21 days and had previously been granted a Sh200,000 cash bail, which he was unable to raise due to his unemployed status and humble background.
Additionally, he stated that holding the accused accountable for other suspects still at large was unjustified and that denying bail without compelling reasons would be denying the accused his rights.
Upon considering the submissions from both parties, the court ruled that the prosecution had not demonstrated compelling reasons to deny the accused bail.
The magistrate ordered that the accused be released on a surety bond of Sh100,000 with two contact persons.
The matter is scheduled for mention on June 4, 2025, for further directions.
