In courts: Sh8.6m graft case against Bomas CEO Koria to be mentioned for pretrial

Milimani Anti-corruption court will today mention a case in which Bomas of Kenya CEO Peter Gitaa Koria was charged with procurement irregularity amounting to Sh8.6 million.

Koria will appear before trial magistrate Celesa Okore for pretrial and fixing the hearing date.

Okore is accused of committing the offence between December 29 and 30 June 2021.

It is alleged that Koria being the CEO and Accounting officer of Bomas of Kenya, wilfully failed to comply with the law relating to procurement.

He was accused of engaging in a procurement process without an approved budget in relation to various tenders during the financial 2020/2021.

The charges indicate that Koria engaged in procurement irregularities in the award of the following public tenders: Quotation No.15/Kitchen Items; Quotation No.16/Utensils; Quotation No.17/Kitchen Items; Quotation No.18/Plates & Cups and Quotation No.19/Cutlery and Other Items which were not factored in the Bomas of Kenya's Budget and Procurement Plan FY 2020/2021.

Also in courts, a magistrate will rule on whether to release on bail a police officer attached to former Sports CS Rashid Echesa and three others linked to a group that allegedly robs Kenyans in Nairobi.

Milimani senior principal magistrate Robinson Ondieki last week, ruled that the prosecution’s application to deny the suspect bail was merited partially.

He dismissed the allegations by the prosecution that the four accused persons were likely to interfere with witnesses.

The accused persons are Aziz Ali, Koffi Bill Atinda, Kennedy Otieno and Kennedy Omwanda.

The officer, Aziz Ali was charged with failing to surrender 14 blanks of ammunition and three tear canisters.

He was accused that on May 17, 2024, at Kizito area in Mwihoko in Kiambu county, being a police officer allegedly failed to surrender 14 blanks of ammunition to the armoury, a duty he was dutifully bound to perform under the National Police Service Act.

The officer faced another count that on the same date and place, he neglected to surrender three tear gas canisters to the armoury.

Atinda was charged that on May 15, 2024, along Narayan Road in the Parklands area within Nairobi City County, having been stopped at an official police roadblock allegedly informed Inspector Onesmus Mutua and Inspector Yusuf Naiwet, persons employed in the Public Service as police officers, that he is an officer of the rank of a Captain in the Kenya Defence Forces (KDF), information which would otherwise prevent the said police officers from arresting him and conducting a search on a motor vehicle.

The High Court will also mention the murder case of George Muchai.

The mention was set for today after the case was adjourned last week after some of the advocates representing the accused persons in the case were a no-show.

Justice Kanyi Kimondo was set to proceed with the hearing with the prosecution having availed one witness for the trial.

But at the point of taking the quorum, the Judge noted that two advocates on record for two accused persons were not present.

The two, Aeric Isabwa alias chairman and Stephen Astiva were willing to cross-examine the police officer who was to take the stand today but the Judge declined.

The judge was forced to adjourn the matter and directed that the advocates be notified of the hearing date by the deputy registrar.

The prosecution remains with five witnesses before it closes its case which was initiated in 2015.
