Driver charged over lawyer's death released on Sh200,000 bond

 A driver has been charged for causing a lawyer's death in Machakos County.

Fidelis Mutuku, the driver who fled after the lorry he was driving allegedly hit a motorbike Morris Mulei was riding on appeared before principal magistrate Ann Nyoike in Machakos Law Courts on Wednesday.

Mutuku faced two charges; causing death by dangerous driving and careless driving.

In the first charge, the court heard that on September 24, 2022, at about 6.00am at Kamuthanga area along Machakos- Kangundo road within Machakos, Fidelis Mutuku being the driver of a motor vehicle registration KCE 352M Isuzu lorry did drive the said vehicle at the said place without due care and attention to other road users and failed to keep his proper traffic lane and therefore hit an oncoming motorcycle registration KMES 915V ridden by Morris Mulei Matheka and as a result of the impact the said rider died.

In the second count, Fidelis Mutuku is said to have driven the said vehicle at the said place without due care and attention to other road users and failed to keep his proper lane and thereby hit an oncoming motorcycle ridden by Morris Mulei Matheka who had a pillion passenger namely Elvis Muindi and the said pillion passenger sustained serious injuries as a result of the impact.

Mutuku was released on Sh200,000 bond or alternative Sh100,000 cash bail and surety of a similar amount.

The case is slated for hearing on October 24, 2022.

Mutuku was arrested on Tuesday, October 4 after the owner of the lorry he was driving during the incident presented him to Machakos police station.

Machakos sub-county police commander Moss Ndhiwa said the suspect had earlier been locked up at Machakos police station before he was arraigned.

The Machakos- based lawyer was a managing partner at O.N Makau & Mulei Advocates.

Mulei will be buried in Kangundo, Machakos County on Friday.
