Businessman Peter Karanja who was charged with the murder of late Tob Cohen was a no show in court today.
Karanja was charged in 2019 alongside Cohen's widow Sarah Wairimu with the offense of murder.
The case was being mentioned on Monday before Justice Grace Nzioka but both Karanja and his lawyer were not present in the virtual court.
The case was being mentioned virtually for re-allocation to another court after trial judge James Wakiaga was transferred last year to the Anti-Corruption division.
However, Judge Nzioka did not issue a warrant but adjourned the matter to Wednesday so that they can be able to trace Karanja's whereabouts.
Wairimu's lawyer Phillip Murgor told the court that there are two pending applications before the court that they have filed.
Justice Nzioka said she will not deal with the issues of applications or directions until Karanja is present in court.
Murgor asked the court to allow Wairimu not to come to his office on Wednesday for the mention because she does not stay in Nairobi.
The court allowed the application for Wairimu to join the virtual proceedings from wherever she will be on that day.
Wairimu travels from outside Nairobi to come to her lawyer's office to attend the virtual courts.
In the new application before the court, Wairimu has made a fresh plea for the trial court to drop the charges saying it's a violation of her rights.
The new judge handling the case is expected to hear this application made by Wairimu.
Early this month, constitutional judge James Makau dismissed an application by Wairimu seeking to stop her prosecution.
Judge Makau ruled that he had no jurisdiction to hear the matter and it should have been filed before the trial court.
