The Constitution specifies that once a person is declared President-elect, and there are no pending legal issues, that person must be sworn in within a specified period.
If the outgoing President is so acidic towards the incoming President, the law is colourless to such attitudes.
Donald Trump, the former US President, was so acidic to President-elect Joe Biden and he never attended his inauguration.
Still, Biden was inaugurated in accordance with the Constitution of the United States.
The same should be in Kenya.
The Assumption of Office Committee must fashion the swearing-in in accordance with the law.
That law is very clear: The instruments of office should be handed over to the incoming President by the outgoing President.
Assuming that the outgoing President does not want to come in, there must be an alternative system of handling over those instruments.
At the moment, those instruments are in the custody of the Kenya Defense Forces because the President is the Commander-in-Chief.
So, the Chief of Staff of the KDF can basically do the handover of those instruments, very easily.
It can also be done either through the Attorney General or through the Speaker of the National Assembly.
Let people not mind the ugly situation. Let it come along, but let the President-elect be inaugurated and be given the instruments of power.
The competition will always be there and whoever does not accept defeat, is not necessarily the winner.
So, the outgoing President should accept and move on.
I also want to tell my good friend Raila Odinga, time is up.
He should not even have agreed to those people who convinced him to go to court without concrete evidence.
As Raila's friend, I waited for his evidence to prove rigging but I didn't see it.
So, if he could not prove beyond any reasonable doubt that Form 34A was swapped with another, then there was no need for him to go to court.
So, the outgoing President should eat humble pie and hand over power to the incoming President.
