Employees of Kitui lender face charges for mistreating loanee

DCI hands over an investigation file to the office of the DPP

The DPP has got the green light to prosecute eight staff of a Kitui financial agency who allegedly mistreated a loanee and took away his water tank and livestock. 

The police handed over the file on Thursday last week.

According to the investigating officers, the employees of the Kabati Financial Services Association raided Cosmas Munyi's home in Kathivo village, Kitui West, and assaulted and injured his wife, before leaving with three  cattle, five goats and the tank.

The incident took place mid-February. They allegedly destroyed a padlock at the gate and gained entry while the victim and his family were still asleep. 

The wife sought a P3 form from the police and had it filled. 

Yesterday, county DCI officer Paul Muchiri said they were waiting for further directions by the office of the DPP if he has any. Otherwise, the office is free to proceed with the case.

“The file is now with the office of the DPP who should advise us on the way forward on the matter. We have accomplished our role,” Muchiri said.

Munyi said the raiders had a sinister motive and arrogated themselves the responsibility of recovering a loan he had not defaulted on, a claim probed and confirmed by the DCI officer.

“I had acquired a loan of Sh95,000 and a tank loan valued at Sh. 96,000, which I was servicing through the agreed monthly installments. I had not defaulted by the time the officers struck and carted away my animals,” he said last Thursday.

He said they also carried away his 10,000-litre tank. Investigators confirmed the claims. 

Munyi has alleged that his wife was brutalized during the dawn incident perpetrated by eight staff of the Kabati Financial Services Association and left with a twisted arm and an injured hip.

Munyi said the FSA officers were later joined by an AP officer. He said they violated the law as they had "no powers to recover the loans through draconian and barbaric ways".

The investigators established that the officers took the law into their hands. Even if the victim had defaulted, the officers should have pursued his guarantors, they said.
