
A petition has been filed in court disputing the capacity and legality of the current Public Relations Society of Kenya (PRSK) Council to call an election.
The petition by Gilbert Awino, a member of the PRSK, could put the much-awaited elections scheduled for October 9, in limbo.
In his supporting affidavit, the petitioner is asking the court to stop the elections, citing violations of the society's own Constitution, particularly Article 18.
He says the council term expired in June this year and that it do have capacity to call for an election.
“I aver that both the AGM and the said elections are contrary to the Constitution of the 1st Respondent and more specifically as outlined herein under. I know of my own knowledge that the Respondents herein have contrary to their very own Constitution called for an Annual General Meeting scheduled for Thursday, October 9, 2025. The call for the AGM is impugned because the term of the current Council lapsed on June 16, 2025 and there was therefore no quorum at the Council to pass the resolution to call for an election,” the affidavit reads in part.
The petitioner further avers that the move by the council to call for an election is a violation of its own constitution.
“I am equally aware that any member of the Council whose term expired on 16th June, 2025 does not have the right to transact as Council member and make decision as such is contrary to the Respondent’s Constitution, null and void. I know of my own knowledge that Article 18(1) of the 1st Respondent’s Constitution that requires elections for the membership of the Council be conducted by such body as the Council may propose and approved by a special or general meeting preceding the election,” the affidavit continues.
The High Court has certified the matter as urgent with further directions expected on October 7, 2025.
"The Application dated 1/10/2025 is hereby certified as Urgent, and directions given as follows: The Application be served today, and an Affidavit of the service be filed before close of business today. A Response be filed within 2 days from the date of service of the Application. Mention on 7/10/2025 for further directions,” the order stated.
