DPP Noordin Haji has filed an appeal challenging Pastor James Ng’ang’a's acquittal in the case of causing a woman's death by dangerous driving.
Ng’ang’a and his co-accused were acquitted on May 4 over the death of Mercy Njeri on the Naivasha-Nakuru highway in July 2015.
The four were set free by chief magistrate Godfrey Oduor at the Limuru law court.
The magistrate held that the Neno Evangelism Centre leader, his driver Simon Kuria and police officers Patrick Baya and Christopher Nzioka had no case to answer.

The officers were accused of giving false witness and misleading investigators.
But the Director of Public Prosecutions disapproved the ruling and said he would appeal it.
"The @ODPP_KE has today filed Criminal Appeal No. 34 of 2018 at the Kiambu High Court."
"...in relation to the acquittal of Apostle Nganga and four others by a Limuru Magistrate's Court," the DPP said in a tweet on Tuesday.
According to the DPP, magistrate Oduor made three key mistakes in acquitting Ng’ang’a and his co-accused.
He said the magistrate did not give reasons for the acquittal.
Noordin also faulted the decision for the magistrate to appear in court and read the judgement in a case that had been heard by another judge.
The court was also faulted for having postponed the case three times in a row before giving its verdict.
