Lang'ata MP Phelix Jalang'o carries a cartonful of evidence to Supreme Court during the filing of Azimio petition on August 22, 2022.

Lang'ata MP Phelix Odiwuor alias Jalang'o has vowed to appeal ODM's decision to kick out 'rebel' MPs.

On Wednesday, ODM's National Executive Committee adopted the committee's recommendations and expelled Jalang'o and four other rebel MPs for "openly associating with and supporting activities of a rival political party".

Speaking on Thursday to TV 47, Jalang'o said that he is still in ODM.

"If you are expelled from a party, it means that you do not have a party and you are not an MP because the party will communicate to the speaker. They will declare your seat vacant and then you go for elections if you will not appeal. But if you appeal, it shows that you do not agree with the party's decision so you meet in court.

"We will be in court until 2027. I am not in a hurry but I am speaking with my lawyers although one of them has also been expelled (Kisumu Senator Tom Ojienda)," he said.

Jalang'o was kicked out of ODM alongside Elisha Ochieng’ Odhiambo (Gem), Caroli Omondi (Suba South), Gideon Ochanda (Bondo) and Kisumu Senator Tom Ojienda.

The MPs met President William Ruto and his Deputy Rigathi Gachagua at State House for breakfast on February 7, 2023.

Since then, he vowed to work with President Ruto.

ODM said the resolution to kick them out followed a NEC meeting held on Wednesday under the leadership of party leader Raila Odinga.

The party said they violated Article 11 (1) (e) of the party constitution and section 14A of the Political Parties Act 2011.

"Members went through the various agendas set for the meeting and after several hours of deliberations, they resolved that these members be deemed to have resigned from the party. The party is hereby directed to commence the process of removing them from the register of the party."
