Azimio senators have for the second time in a row skipped the grilling session for Cabinet Secretaries.
The minority party has questioned the legality of the ministers' appearances in the chamber.
Seats in the opposition wing remained empty on Wednesday as CSs responded to questions from the lawmakers on the floor of the house.
Machakos Senator Agnes Kavindu (Wiper) was the only opposition lawmaker present in the House during the morning sitting.
Deputy Minority leader Enoch Wambua (Wiper) walked into the chamber but left soon after.
Minority Whip Ledama Ole Kina termed the appearances of CSs as unconstitutional.
“It is totally against the basic structure doctrine of the Kenyan Constitution. Amending article 153-3 of the Kenyan Constitution using Standing Orders. Totally absurd,” he said.
The absence of the opposition allied senators could deny their electorate an opportunity to get responses from key ministries.
The Azimio senator had also last week skipped the inaugural question time when CSs appeared before the house.
They said that they will not attend the sessions until a case they filed in court challenging the CSs' appearance is heard and determined.
"We have filed a case in court challenging the constitutionality of the appearances. We shall await the hearing and determination of our case to decide how to proceed," Wambua told the Star last week.
In March, the Kenya Kwanza senators pushed through amendments to the house rules (standing orders) to pave the way for the CSs to answer questions on the floor of the House.
But the opposition senators accused the government wing of attempting to amend the constitution through standing orders.
