Judgment went God's way, Babu Owino says after acquittal

The court said the prosecution failed to prove he shot DJ Evolve on January 17, 2020.

Embakasi East MP Babu Owino has attributed his acquittal to God in the case where he had been charged with misusing his firearm in relation to the 2020 shooting of DJ Evolve.

The legislator was facing the charges for allegedly shooting the disc jokey in the neck on January 17, 2020, at B-Club entertainment spot in Kilimani, Nairobi.

A magistrate on Tuesday set him free saying the prosecution failed to prove its case. 

"This judgment has gone the way the Almighty God wanted it to go," Babu said during a media interview at Milimani Law Courts on Tuesday.

However, the lawmaker said his real victory will come the day the DJ, whose real name is Felix Orinda, will regain his ability to walk again.

"The day that I will be victorious is the day that I will see DJ Evolve walk (and) stand by my side," he said.

He assured that he will continue supporting the DJ who remains bedridden "and in fact, I'm planning to take him to India for further treatment".

The MP thanked all those who stood by him during the entire period of the course of the case starting with his wife and family.

"I also want to thank DJ Evolve, Felix Odhiambo Orinda for being my friend, for trusting in our friendship for always being there for me," he said.

The court said the prosecution did a 'shoddy job' as no medical evidence was tendered to show what injuries DJ Evolve sustained or prove that Babu was drunk and behaved in a disorderly manner on the night of the alleged shooting.

Milimani Senior Principal Magistrate Bernard Ochoi said the Investigating officer appeared to have been relying on CCTV footage.

"In my view, the footage can't be substituted for medical evidence. A medical report or P3 form should have been availed to confirm the victim had suffered a gunshot wound," he said.
