An MP from Kirinyaga county is embroiled in a battle for land with a family in Kiambu county.
The Kiambu family plans to file a case against the legislator saying they lost a prime parcel in Ruaka, Kiambaa constituency worth Sh80 million.
But when reached for a comment, the MP said he bought the land from some of the Kiambu family members who he said had a ready title deed for the land.
"I have copies of the succession that he (one of the brothers) did without my help. I was not there during the succession. If there was any family feud, I was not aware of it since this was a buyer-seller transaction," the legislator said.
He said he followed the right procedures of acquiring land, and dismissed claims he influenced two family members to sell him the parcel.
The family of Munyui Gathwira (deceased), has accused the legislator of conspiring with some family members to deprive other members of their inheritance land.
According to Fredrick Mburu, Gathwira's son, the legislator bought the land without the consent of all family members.
"We are seven members who were documented as beneficiaries. We only recently learnt that two of our brothers conspired with the legislator and sold the land without our consent," Mburu said.
He added that the MP helped alter the ownership of LR Kiambaa/Ruaka 618 measuring 0.510 acres.
This saw the removal of one of their brother David Ngigi as the registered co-administrator of the land, while other family members were listed as deceased.
"The sale of our land was facilitated after it was claimed that we are deceased. Our father's legacy was meant for all of us and we have never authorised any transfer of ownership," he said.
The family members claimed corrupt dealings were undertaken with land officials in Kiambu lands registry who were issued with fake death certificates of family members.
"Corrupt land officials in Kiambu facilitated this egregious act by accepting fraudulent death certificates. We are shocked and appalled by this blatant corruption," Mburu said.
He said once he got wind of the sale, he immediately mobilised his siblings to put a restriction on the land issued in the office of the assistant county commissioner in Kihara, Kiambaa.
The restriction letter drafted by five of the brothers and presented to Kihara assistant county commissioner Eldwin Ongeto on April 20, 2023, claimed their brother registered LR Kiambaa/Ruaka 618 under his name.
The brothers expressed concerns that their two siblings had plans to dispose the land without the consent of all parties.
“We request you to kindly restrict the land until such a time both parties come to an agreement," read part of the restriction letter.
But the family claims the legislator was able to remove the restriction, enabling the successful transfer of the land documents.
They have vowed to fight tirelessly until justice is served.
"The MP and our brothers will face the consequences of their actions. We demand accountability and restitution for this injustice perpetrated against our family," Mburu said.
