Court issues warrant of arrest against fugitive murder suspect Kang'ethe

A warrant of arrest has been issued against fugitive murder suspect Kevin Adam Kinyanjui Kang'ethe.

Milimani Chief Magistrate Lucas Onyina gave the orders on Friday after an application by the prosecution, who said Kang'ethe is a dangerous person.

"In the view of the application that the respondent escaped jail, a warrant of arrest is issued as sought," Onyina ordered.

The court heard that Kang'ethe escaped lawful custody at Muthaiga Police Station on February 7, at around 4 pm.

The state has already filed an affidavit to support the application.

In the said affidavit sworn by one Patrick Wachira, a signal by the OCS Muthaiga Police Station confirms the escape and the fact that the man is yet to be arrested.

"In circumstances, on behalf of the applicant, the DPP, based on the affidavit, we will be requesting for a warrant of arrest to be issued, addressed to the Homicide Division of the DCI," Prosecution Counsel Vincent Monda said.

The respondent's counsels led by lawyer Mohamed Amin Ahmed however opposed the application, arguing that it could not be assumed that Kang'ethe escaped police custody.

Ahmed told the court that last Friday, he visited the suspect at the police station and the whole time, there was an officer in the room.

"We don't know who took him. We are fearing for his life. The court should not assume he escaped lawful custody until we have clear evidence from the officers at Muthaiga Police Station," he argued.

His opposition was however met with Monda's response that the police are carrying out investigations on the offence of aiding a suspect escape from lawful custody.

"We have placed material sufficient for this court to act on," the prosecutor added.

Upon determination of the submissions, the court gave the orders sought.

The mention is set for February 19.

Then, the prosecution stated that it would indicate to the court how it wished to proceed with the case, especially on the application for extradition.

Kang'ethe is now a wanted man both in the United States of America and in Kenya.

He is suspected of having killed his girlfriend Margaret Mbitu and left her body in a car packed at a Boston Airport in Massachusetts.

He then escaped into the country.
