The County Assembly of Nairobi

Azimio coalition on Tuesday de-whipped three Nairobi county Jubilee MCAs for going to bed with the government.

In a letter dated April 24, 2023, and seen by the Star, Majority Whip Moses Ogeto discharged the three Jubilee MCAs from House committees.

The MCAs include Nominated MCA Wanjiru Kariuki, Karura ward rep Kamau Fiu Fiu and Robert Mbatia of Kariobangi South. Each of the members received their letters personally.

“I'm in receipt of an official communication from Jubilee party dated April 20, 2023, documenting the various unethical dalliance and open affection towards our rival coalition; Kenya Kwanza Alliance as it has been reported by Kioni,” reads the letter.

Last week, Kioni gave the majority whip the greenlight to take disciplinary measures against the three rebels.

"Other measures being taken by the party, to install discipline within our coalition and respect for multi-party democracy will be notified to yourself on a different date, " Kioni said.

As a result, Ogeto explained that following the complaints, the matter is treated as serious misconduct by the MCAs.

“As a result, it has prompted my office to invoke Standing Order number 172 (4) ,” he added.

The Standing order 172 (4) states that a notice of discharge from a committee of its chairpersons and vice chairpersons shall be communicated in writing to a member at least seven (7) days before such discharge is to be effected and a new chairperson or vice chairperson elected pursuant to paragraph (2) to standing order 175.

“You are hereby given a notice discharge as per the relevant standing orders from the following assembly house committees,” the letter reads further.

The letter was copied to the office of the speaker, majority leader and Jubilee party.

Jubilee acting secretary general Kanini Kega had earlier termed Kioni’s communication as null and avoid.

Kega noted that Kioni could not speak on behalf of the Jubilee party following the judgment last week.

"Accordingly any communication by Kioni to your good office or to any honourable member of our party purporting to be the official position of Jubilee party will be null and void and of no consequence," he said.

Last week, the Political Parties Tribunal declined to quash NEC's resolution that installed Eala MP Kanini Kega as his replacement.

This means that the fate of besieged Kioni lies with the party's internal dispute resolution committee.

In its judgment delivered on April 16, the tribunal said that the notice for the National Executive Committee meeting issued on February 2 and the subsequent NEC meeting on February 10 which imposed Kega was done in accordance with the party Constitution.

However, Majority Whip Ogeto said he was not in receipt of any letter apart from Kioni's
