Court upholds Wajir North MP Ibrahim Saney's win

High Court upholds Wajir North MP Ibrahim Saney's win and dismissed his rival Ibrahim Ahmed's petition that was challenging his win.

Justice Reuben Nyakundi ruled that Ahmed did not prove his case against Saney.

“With regard to the given complexity and challenges experienced on August 9, 2022, by the constituent of Wajir North it’s clear that the election in question was manifested was substantially conducted in accordance with the law save for the last minute phase,” he said

However, the court also noted there were administrative and procedural challenges due to the violence that erupted at the rallying centre.

“Despite the formation act of omission and commission I rule that the election of Wajir North was conducted in substantial compliance and I find no reason to invalidate the win by Saney,” the court ruled

Saney and IEBC have been awarded costs to be paid by Ahmed

“The costs are capped at a maximum of Sh4 million which will be shared between IEBC, the returning officer and Saney” the judge ruled
