What not to do on Tuesday when voting

Election offences attract up to Sh1 million in fines, six-month jail term or both.

On Tuesday, August 9, some 22,120,458 voters will wake up to go and cast their votes in Kenya's 7th general election since the introduction of multipartism in 1992.

The number includes 7,483 prisoners and 10,444 voters who will cast their ballots in Kenyan embassies and missions in the diaspora.

The voters will be choosing leaders across six elective seats; the president, governor, senator, member of National Assembly (MP), woman representative and ward representative (MCA).

The voting will take place across 46,229 polling stations gazetted by the Independent Electoral and Boundaries Commission (IEBC).

As a voter, the Elections Act, 2016, contains numerous offences which you shouldn't commit on polling day.

Anyone who commits any of the offences is liable to a fine not exceeding one million shillings or imprisonment for a term not exceeding six years or both.

It's highly advisable that you familiarise yourself with the offences to avoid getting yourself into trouble.

This is what you should not do on voting day;

1. Forge, deface or destroy a ballot paper.

2. Supply ballot papers to any person without authority.

3. Sell or offer for sale any ballot paper.

4. Purchase or offer to purchase any ballot paper from any person.

5. Be in possession of any ballot paper other than when voting.

6. Drop into any ballot box anything other than the authorised ballot paper.

7. Take any ballot paper out of a polling station.

8. Remove election material from a polling station before, during or after the election.

9. Destroy, open, dispose or interfere with any election material.

10. Print a ballot paper or what purports to be a ballot paper.

11. Be in possession of any appliance, device or mechanism that can interfere with ballots.

12. Make markings on another voter's ballot papers.

13. Vote more than once.

14. Interfere with another voter while casting their vote in secret.

15. Pretend to be unable to read or write so as to be assisted in voting.

16. Pretend to be visually impaired or suffering from any other disability so as to be assisted in voting.
