Acting in accordance with the constitution, judge Lawrence Mugambi sentenced acting Inspector General of Police Gilbert Masengeli to six months in prison for contempt of court.
What followed was the withdrawal of the judge's security detail. This action, coming on the heels of Justice Mugambi sentencing the acting IG for defying multiple court orders, raises serious concerns about the integrity of judicial processes.
It is a troubling development that undermines the independence of the Judiciary.
The timing of this action, directly following a decision that seems to have displeased certain people in power, raises serious questions about its intent.
The move not only jeopardises the safety of a sitting judge but also undermines the rule of law and the administration of justice.
Judges must be able to make decisions impartially, based solely on legal principles, without fear of retribution from other branches of government.
The timing of the security withdrawal suggests a retaliatory motive, which could deter judges from issuing rulings that might displease big and powerful individuals or institutions.
Such actions jeopardise the foundational principle of judicial independence, potentially compromising the fair administration of justice.
For a Judiciary to function effectively, it must be insulated from external pressures and threats. The removal of Justice Mugambi’s security not only appears punitive but also sends a dangerous message about the consequences of upholding the rule of law against influential individuals.
Any attempt by the mighty and powerful to undermine judicial independence not only weakens the legal system but also erodes confidence in our institutions and we should not let this happen in our country.
Protecting judges from any form of intimidation is essential for upholding the rule of law and maintaining public trust in the Judiciary and therefore it is imperative that judge Mugambi's security be reinstated immediately.
