The Senate has invited members of the public and stakeholders to submit written memoranda on the proposed Quality Healthcare and Patient Safety Bill, 2025
The Bill aims to strengthen the regulation, quality and safety of healthcare services across the country.
The Bill, which was read for the First Time in the Senate on July 15, has since been committed to the Standing Committee on Health for consideration before being debated by the House.
In a public notice issued on Tuesday, the committee said it is conducting public participation in line with Article 118 of the Constitution and Senate Standing Orders, which require Parliament to facilitate public involvement in the legislative process.
"In accordance with the provisions of Article 118(1)(b) of the Constitution and standing order 145(5) of the Senate Standing Orders, the Standing Committee on Health now invites interested members of the public to submit any representations that they may have on the Bill by way of written memoranda," the public notice read in parts.
The proposed law seeks to give effect to Article 43(1)(a) of the Constitution by establishing a comprehensive legal and institutional framework for promoting, regulating and continuously improving the quality of healthcare in Kenya.
According to the committee, the Bill sets out the rights of patients and the corresponding obligations of healthcare facilities while introducing measures aimed at improving accountability in the health sector.
It also proposes the establishment of the Quality Healthcare and Patient Safety Authority, which will be responsible for registering, licensing, accrediting and inspecting health facilities across the country.
In addition, the Bill seeks to create a specialised Health Care Tribunal to hear and determine disputes arising within the healthcare sector and prescribes offences and penalties for individuals or institutions that fail to comply with the proposed law.
The committee has urged interested individuals, professional bodies, civil society organisations, healthcare providers and other stakeholders to submit their views in writing before the deadline.
Memoranda should be addressed to the Clerk of the Senate and may be submitted by post, hand delivery to the Office of the Clerk of the Senate at Parliament Buildings in Nairobi, or electronically through the official Senate email addresses.
All submissions must reach the committee by 5 pm on Monday, August 3, 2026.
The Senate said copies of the Bill and a digest outlining its contents and context are available on the Parliament website to enable the public to review the proposed legislation before making submissions.
The public participation exercise forms part of Parliament's constitutional obligation to consider the views and recommendations of citizens before finalising legislation.
If enacted, the proposed law is expected to provide a uniform legal framework for improving healthcare quality standards, enhancing patient safety, strengthening oversight of health facilities and providing a structured mechanism for resolving healthcare-related disputes.
